These Terms of Service ("Terms") govern your use of 45 (the "Service"), provided by 45 ("we", "us"). By downloading or using the app, you agree to these Terms.
1. The service
45 is a desktop productivity application for Windows that enforces focused work sessions by blocking distracting websites and applications. The Service includes the desktop app, any associated account portal, and team management features.
2. Subscriptions and billing
Access to 45 requires a paid subscription after the 7-day free trial. Subscriptions are billed monthly or annually as selected at signup. All payments are processed by Stripe.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods, except where required by law.
We reserve the right to change pricing with 30 days' notice. If you do not accept a price change, you may cancel before it takes effect.
3. Free trial
New accounts receive a 7-day free trial. No payment method is required to start a trial. At the end of the trial period, the app stops working until a subscription is activated. We do not automatically charge you at the end of the trial.
4. Team subscriptions
Team subscriptions are billed per seat on an annual basis with a 10-seat minimum. The team administrator is responsible for payment and for ensuring that employees who receive access agree to these Terms. Seats can be added or removed at any time; changes are reflected in the next invoice.
5. Acceptable use
You may not:
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Circumvent or disable the app's blocking mechanisms for the purpose of reselling or distributing a modified version
- Use the Service in any way that violates applicable laws or regulations
- Share your account credentials with others (each seat is for one individual)
6. The app modifies your system
During an active sprint, 45 sets a Windows system proxy and monitors running processes. These changes are fully reversed when the sprint ends or the app closes. By using the Service, you consent to these modifications during active sessions. You should not use 45 on systems where proxy changes are prohibited by IT policy without first obtaining appropriate authorization.
7. Camera feature
The presence detection feature is opt-in and uses your device's camera to check whether you are at your desk. No video or images are stored or transmitted. By enabling this feature, you consent to the app accessing your camera during active sprints.
8. Disclaimer of warranties
The Service is provided "as is" without warranty of any kind. We do not guarantee that 45 will be uninterrupted, error-free, or that it will improve your productivity. You use the Service at your own risk.
9. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service, including but not limited to loss of data, lost productivity, or system issues caused by proxy or process monitoring features. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service if you violate these Terms, with or without notice. You may terminate your account at any time by cancelling your subscription and uninstalling the app. Upon termination, your local data remains on your device; we delete your account record from our servers within 30 days.
11. Changes to these terms
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Switzerland, unless otherwise required by applicable consumer protection law in your jurisdiction.
