Questions we get from HR.

Does this constitute employee monitoring under GDPR / labor law?

No. 45 collects no identifiable employee data — not their name, not their tasks, not their browsing. The camera presence check runs locally with no video transmitted. Because there is no personal data collected, it falls outside the scope of most workplace surveillance regulations, including the GDPR and German Betriebsverfassungsgesetz. We're happy to provide a technical data-flow document for your works council.

Can our works council (Betriebsrat) block this?

Unlikely. Works councils typically scrutinize tools that collect personal data or enable per-person monitoring. 45 doesn't do either. We can provide a one-pager describing exactly what data is processed and where, which is usually sufficient for a council review.

What happens to data when an employee leaves?

Revoke their seat from your dashboard. Their app stops working within 24 hours. Their local sprint history stays on their personal machine — we never held it. There is nothing to delete from our systems because it was never there.

Can we get a DPA or MSA?

Yes for team subscriptions of 25+ seats. Email hello@45.day with your standard template and we'll review within 5 business days.

What if an employee doesn't want to use it?

45 is never mandatory — it's a benefit, like a gym subscription. Employees opt in, install it themselves, and can uninstall at any time. You can't see whether any individual person uses it or not.

Is this compatible with our IT security policies?

In most cases yes. 45 sets a local Windows system proxy during a sprint and removes it when the sprint ends. It doesn't install drivers, system services, or browser extensions. For a detailed technical spec, email us.
